Terms of Service

By subscribing to or using Peakwise (the “Service”), you agree to these Terms of Service (“Terms”). The Service is operated by PredictIQ AI LLC (“we,” “our,” or “us”). If you do not agree, do not use the Service.

Peakwise provides a demand intelligence API and data platform for hospitality operators. We deliver daily demand scores, 90-day forecast calendars, event signals, weather impact, and competitive rate benchmarks for supported markets.

Demand scores are estimates derived from public signals and proprietary models. They are provided for informational and planning purposes only — they are not guarantees of actual future demand, occupancy, or revenue.

Your API key grants access to the Service according to your subscription tier. You are responsible for keeping your API key confidential. Do not embed it in client-side code or public repositories. Notify us immediately at [email protected] if you believe your key has been compromised — we will rotate it at no charge.

Subscriptions are billed monthly in advance via Stripe. Your subscription tier determines which markets you may access and the maximum forecast horizon available through the API.

• Explorer (free): 30-day forecast horizon, 1 market, rate-limited.
• Professional ($99/mo): 90-day horizon, 1 market.
• Agency ($299/mo): 90-day horizon, up to 3 markets, enhanced explainability.

Prices are subject to change with 30 days’ notice to active subscribers.

You agree not to:

• Resell or redistribute raw API data to third parties without written permission
• Reverse-engineer the demand models or scrape the API beyond your tier limits
• Use the Service for any unlawful purpose
• Share your API key with users outside your organization

All demand scores, forecasts, signals, and analytics produced by the Service are the intellectual property of PredictIQ AI LLC. You may use the data internally for your business operations. You may not republish raw data feeds without a separate data licensing agreement.

The Service is provided “as is.” To the maximum extent permitted by law, PredictIQ AI LLC is not liable for any indirect, incidental, or consequential damages arising from use of or reliance on the Service, including pricing decisions made based on demand forecasts. Our total liability for any claim is limited to the fees you paid in the 30 days preceding the claim.

We may suspend or terminate your account if you violate these Terms. You may cancel your subscription at any time — see our Refund & Cancellation Policy.

We may update these Terms with 30 days’ notice to active subscribers. Continued use after the effective date constitutes acceptance.
